Having a credit card (or not) has nothing to do with owing a debt. You received services at the E.R. and you owe for those services. The collection agency can sue YOU - not your husband.

They can keep calling you or your husband until you tell them not to.
They can send you dunning letter asking for payment
They can report you and your husband to the credit bureaus.
They take you to court and get a judgment against you.
With a judgment they can garnish your wages, seize your bank accounts, and put liens on any property that you may own.
Mother-In-Law is partially correct. A creditor cannot sue a debtor while he is on active duty in the military. But, maybe she knows something else that no one else knows. Ask her.
